EB-1A Green Card

​EB-1A is a green card category specifically designed for individuals with extraordinary ability. It is classified as the first preference category for employment-based immigration and does not require sponsorship from a U.S. employer or job offer. The EB-1A category targets exceptional talent across various fields, including science, arts, education, business, and athletics.

Eligibility Requirements

Applicants must demonstrate a record of extraordinary achievement and recognition in their field.

This can include receiving a major, internationally recognized award such as a Nobel Prize or Pulitzer Prize, or meeting at least 3 out of the following 10 criteria:

  1. Receipt of nationally or internationally recognized awards.

  2. Membership in associations requiring outstanding achievements in the field.

  3. Media coverage of the applicant’s work or achievements.

  4. Serving as a judge or evaluator of the work of others in the same field.

  5. Significant original contributions to their field, either scholarly or artistic.

  6. Publication of professional articles in major journals, media, or other platforms.

  7. Participation in national or higher-level exhibitions or showcases.

  8. Holding key leadership or critical roles in professional organizations.

  9. Earning a salary or compensation significantly higher than others in the same field.

  10. Commercial success in performing arts (e.g., box office revenue, album or DVD sales).

 

Required Documentation

  1. Evidence demonstrating the applicant’s extraordinary achievements and recognition in their field.

  2. Proof that the applicant will continue to work in their field of expertise after obtaining the green card.​

Application Fee

Government fees

  • Base Application Fee (I-140): $715

  • Premium Processing Fee (Optional): $2805

  • Additional Fees:

    • Individual applicants or small companies (≤25 employees): $300

    • Large companies (>25 employees): $600

Processing Time

  • Standard processing: 4-7 months

  • Premium processing (optional): Results within 15 business days for eligible cases
